1. This agreement is with us, not with Apple

Geoplate: GPS Timestamp Camera (the "App") is published under the trading name WHITE APPS ("we", "us"). By downloading or using the App you accept these Terms of Use, which form a binding agreement between you and us.

This agreement is concluded between you and us alone, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.

2. Age

You must be at least 13 years old to use the App. If you are under 18, use it with the permission of a parent or guardian. Buying anything requires an Apple ID, which has its own age rules.

3. Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

You may not sell, rent, sublicense or redistribute the App; copy or extract its templates, styles or artwork; reverse-engineer or decompile it, except where that restriction is prohibited by law; get around its save limits or its security measures; or use it to build a competing product.

4. What is free and what is Pro

• Free: shooting photos and videos with the stamp, adding a stamp to old photos, projects, the gallery, templates and stamp settings, and a limited number of saves of stamped files to Photos. Shots you take stay in the App with no limit.
• Pro: unlimited saves of stamped files to Photos, and the choice to remove the Geoplate name from the stamp. The features included in Pro are listed on the purchase screen and may grow over time.
• What counts as a save. A stamped photo or video counts once, when it is first written to Photos from the App. Saving the same file again, or saving a version without the stamp, does not use another free save. The count is kept on your phone and stays after you reinstall the App.

5. Subscriptions

• Plans. Pro is offered as a weekly subscription and a yearly subscription, in one subscription group, and also as a one-time purchase (section 6). The price, billing period and any free trial are shown on the purchase screen before you pay. Prices vary by country and may change; what is on the screen when you confirm the purchase is what you are charged.
• Free trial. Where a plan offers one, the trial and its length are shown on the purchase screen together with the date the first charge happens. Apple allows a free trial once per subscription group. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
• Payment is charged to your Apple ID when you confirm the purchase, or when the trial ends.
• Auto-renewal. The subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends.
• Switching. Moving between the weekly and the yearly plan is handled by Apple as an upgrade or downgrade within the same group.
• Cancelling. Manage and cancel in Settings → your name → Subscriptions on your device. We cannot cancel for you. Deleting the App does not cancel a subscription. Cancelling stops the next charge; Pro stays active until the end of the period you already paid for.
• Restore. After reinstalling or on a new device, use "Restore purchases" on the purchase screen or in Settings. Use the same Apple ID you bought with.
• When a subscription ends. Your shots, projects and settings stay in the App, and every file you already saved to Photos stays in Photos exactly as it was. Unlimited saving stops, so the free saves apply again, and new shots carry the Geoplate name on the stamp.

6. One-time purchase

The one-time purchase unlocks Pro without renewal and is not a subscription. It is tied to your Apple ID and can be brought back with Restore purchases, on a new phone or after a reinstall.

7. Refunds

Refunds for App Store purchases are handled by Apple under Apple's policies, not by us. Request one at reportaproblem.apple.com. If something went wrong on our side, write to us and we will help where we can.

8. Your photos, your place, and the stamp

You keep all rights you have in the photos and videos you shoot or add. We do not receive them (see the Privacy Policy), so we do not license, use or publish them.

The stamp is a label drawn on the file. The app fills it from your iPhone's clock, time zone and location, or from values you pick yourself: you can change the date, time and place before you save. The app does not certify that a date, time or place is right, and a stamped file is not an official document. The address and map come from Apple's services and can be inexact. Compass heading, altitude and accuracy depend on your phone and its surroundings.

9. Acceptable use

You agree to:

• use the stamp honestly: not to pass off a date, time or place you know to be wrong as true to anyone who relies on it, for example in a dispute, a report, a contract, an application or a payment;
• respect the privacy of the people you photograph and the places where photography is not allowed, and follow the law where you are;
• not use the App to stalk, harass or follow anyone, or to put someone's place at risk by publishing it;
• not try to bypass the save limits, the purchase checks or any other protection in the App, or to copy the App's protected previews.

We may stop supporting an install that breaks these rules.

10. Our content

The App's design, templates, styles, icons, name and logo belong to us or are used with permission, and are protected by copyright and other laws. Your licence does not transfer any ownership of them.

11. Third-party terms and services

You must comply with applicable third-party terms when using the App, including the Apple Media Services Terms and Conditions. The address, search and map on the stamp depend on Apple Maps services, and purchases depend on Apple and RevenueCat; they may be unavailable at times. We may change templates, styles and what Pro includes over time.

12. Maintenance and support

We, not Apple, are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Contact us at [email protected].

13. Warranty

The App is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by applicable law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that a place, address or map on a stamp will be exact.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other complaints, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

Nothing here limits statutory consumer rights that cannot be waived.

14. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages arising out of your use of the App, including the loss of shots stored only in the App on your device, or how you or others use stamped files. This does not limit liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

15. Complaints and legal demands about the App

We, not Apple, are responsible for addressing any complaints or legal demands by you or any third party relating to the App or your possession and use of it, including product liability, any failure of the App to conform to any applicable legal or regulatory requirement, and matters arising under consumer protection, privacy, or similar legislation.

If a third party alleges that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that allegation.

16. Legal compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Ending this agreement

This agreement is effective until terminated by you or by us. Your rights under it end automatically if you fail to comply with any of its terms. You may end it at any time by deleting the App - remembering that this does not cancel an active subscription, and that it deletes the shots stored only in the App on that phone.

18. Changes to these terms

We may update these terms as the App changes. The current version always lives on this page with its date at the top. If you keep using the App after an update, you accept the updated terms.

19. Apple as third-party beneficiary

You and we acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms of Use, and that upon your acceptance of these terms Apple will have the right - and will be deemed to have accepted the right - to enforce these Terms of Use against you as a third-party beneficiary of them.

20. This website

The website geoplate.app and its free photo tool are free to use as they are, without warranties, under the same limits as sections 13 and 14. The tool draws a label on your own photo in your browser: the same honest-use rules as in section 9 apply to what you make with it. How the website handles data is described in section 16 of the Privacy Policy.
